Terms of Service

1. Acceptance of Terms

By engaging with CreativeReachLab's services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services. These terms apply to all advertising, outreach, and creative services provided by CreativeReachLab, located at Fuchswegela 3a, 87459 Pfronten, Germany.

2. Scope of Services

CreativeReachLab provides creative advertising, influencer outreach, and demand generation services. Specific deliverables, timelines, and pricing are outlined in individual project agreements or service descriptions. We reserve the right to modify service offerings with reasonable notice.

3. Client Obligations

Clients are responsible for:

  • Providing accurate and complete information required for service delivery
  • Timely review and approval of deliverables
  • Ensuring all content provided does not infringe third-party rights
  • Maintaining confidentiality of project-specific strategies

4. Payment Terms

Payment terms are specified in individual project agreements. Unless otherwise stated, invoices are due within 14 days of issuance. Late payments may incur a statutory interest rate of 9 percentage points above the ECB base rate per § 288 BGB. All prices are exclusive of VAT (MwSt.) where applicable.

5. Intellectual Property

Upon full payment, clients receive a non-exclusive, perpetual license to use deliverables for their intended purpose. CreativeReachLab retains the right to display completed work in portfolios and marketing materials unless explicitly restricted in the project agreement.

6. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the course of engagement. This obligation survives termination of the service agreement for a period of 24 months.

7. Limitation of Liability

CreativeReachLab's liability is limited to direct damages up to the total fees paid for the specific service giving rise to the claim. We are not liable for indirect damages, lost profits, or consequential losses. Performance metrics (e.g., ROAS, engagement rates) are targets, not guarantees.

8. Termination

Either party may terminate a service agreement with 30 days written notice. Early termination by the client does not entitle a refund for work already completed or resources already allocated. CreativeReachLab reserves the right to terminate immediately in cases of non-payment or breach of these terms.

9. Governing Law

These terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be submitted to the exclusive jurisdiction of the courts in Kempten (Allgäu), unless mandatory consumer protection laws apply.

Refund & Reimbursement Policy

1. General Policy

CreativeReachLab is committed to delivering high-quality advertising and outreach services. Due to the nature of creative and digital services, refunds are evaluated on a case-by-case basis in accordance with German consumer protection law (§§ 312g, 355 BGB).

2. Right of Withdrawal (Widerrufsrecht)

Consumers have a 14-day right of withdrawal from the date of service agreement for digital services, as per § 356 BGB and EU Directive 2011/83/EU. To exercise this right, you must inform CreativeReachLab of your decision to withdraw by contacting:

Note: If services have already commenced with your explicit consent before the withdrawal period ends, you may be liable for the proportional cost of services rendered.

3. Milestone-Based Projects

For projects with defined milestones:

  • Refunds are available for unpaid milestones only
  • Completed and approved milestones are non-refundable
  • In-progress work may be subject to partial billing based on completion percentage
  • Client-requested scope changes after approval incur additional charges at standard hourly rates

4. Subscription & Retainer Services

Monthly retainer and subscription services can be cancelled with 30 days written notice. The current billing period will be fulfilled. No partial month refunds are provided unless CreativeReachLab fails to deliver agreed-upon services.

5. Non-Refundable Items

The following are not eligible for refunds:

  • Third-party costs incurred on your behalf (ad spend, influencer fees, software licenses)
  • Work completed and approved by the client
  • Services where the delay or failure was caused by client inaction
  • Custom or bespoke creative work after first draft delivery

6. Refund Process

To request a refund, contact us at [email protected] with your project details and reason for the request. We will acknowledge receipt within 2 business days and provide a decision within 10 business days. Approved refunds are processed within 14 business days to the original payment method.

7. Dispute Resolution

If you are unsatisfied with our refund decision, you may contact the European Online Dispute Resolution platform at https://ec.europa.eu/odr. CreativeReachLab is not obligated to participate in alternative dispute resolution but will consider requests in good faith.
